There are technical and legal reasons for why we are where we are.
I understand MOUL uses Oracle for its database services, which is proprietary and costly. There has been lots of discussion on what other proprietary software might be in the MOUL version. I think it is down to just Oracle and Plasma and Cyan said they would license Plasma as open source. I assume they are separating out any proprietary parts or working deals to allow use. So, yes they would need to change it for us and it is those changes Cyan is making and that proprietary stuff Cyan does not own prevents them from just giving us what they used. However this only prevents us from using the MOUL server software.
Alcugs is an alternative game server. I've never gotten into the details of it but I would assume it is mostly open source and available for fans to use. Does it come with a client side? I don't know. If not, that eliminates new players that do not have CC or another client side way to view the game. We cannot legally redistribute CC or the MOUL client (player side software).
If one had server software that would run the game and client software that people could download to access the game then we could run fan made content right now. That would be legal and is doable. There are probably a bunch of techicalities to legally using the CC/ABM player side software but it could be changed to use say Andy's Nexus in place of any Cyan content.
The Uru content has also not been licensed to us by Cyan. So, we can't just use it. There is no such issue with fan created content. If the writer used Cyan textures or other materials to create the age, there may be some issues related to those per those agreements.
There are rouge game servers and the issues with them are which software are they using for the server and the content they are serving. I suspect Cyan would not have a problem if it were just server software. But, Uru, Myst V, MOUL and other parts of the Myst series seems to be getting involved. That makes for an amazingly complex legal mess of who has what rights.
