I'm puzzled as how you can be sure without any facts. Regardless as what it may have originally been developed for, the Descent as seen in Myst V was published in a game called Myst V, not Uru. There is no evidence one way or another that anyone other than Ubisoft has the right to publish any content from Myst V, especially as it was seen in Myst V.(Of course K'veer already appeared in Uru before Myst V, so it could reappear in MO:UL as it did in Uru as per the Cyan/Ubisoft agreement for MO:UL.) But since you like speculation I'll speculate a bit too: Cyan can argue that they could self-publish anything not developed for or seen in Myst V. So they could publish a DIRT version of the Descent with all modeling, shading and texturing from 2001 since this is not Myst V content. Maybe Ubisoft would take them to court, but that's speculation based on speculation. Maybe Cyan has already reached an agreement with Ubisoft on Myst V like they did with Uru and this is all a non-issue, but that too is.......(see what I'm driving at here?)
And this is where your logic fails to grasp a simple concept: You named K'veer, which fits perfectly into the EXACT same situation as Descent falls into. Descent and K'veer we're both developed for DIRT/Mudpie/Uru etc. Both were scaled down for their official releases in Uru. The hallways/Great Room of K'veer as scene in Myst V were originally intended for Uru. Heck the physics for them were distributed with Uru, just as a single part of Descent was distributed with Uru, while the rest of it was scrapped. Then came Myst V, and both of these ages were released in the entirety that we saw them. Then MOUL came along and the Myst V bubble was stripped from K'veer, the Bahro were stripped out, and a nexus put in. While little was done to Descent because of the massive work needed in comparison. But both fall into the exact same category, and thus logic and law dictates that if both situations are the same, then both rulings on who owns the rights to it will both fall into the same category. If the situation is the same (which it is), and the facts of both cases are the same (which they are) then the outcome for both will be the same. If the variables are the same, the outcome of the equation will always be the same.
And if you doubt that, then why do objects that appear in both K'veers and Both Descents appear in BOTH versions. The Descent in Myst V IS the one from Uru. The objects in that part of Descent are the same objects. Same names. Same materials. Same textures. Heck one of the Lights in both versions is called RTWatsonLampLight. It's the light that is next to the cot in Eder Tomahn, and it appears in both. Content from Uru, was used in Myst V. Period. It belongs in Uru. Period.
